Officers responded to the intersection of Post Road and Brookside Road on Wednesday, Dec. 26 around 3 p.m. after hearing a report of a motor vehicle accident. The other party involved in the accident was able to provide a license number, and a Norwalk officer eventually located the vehicle on West Avenue near Maple Street.
When asked whether she had been in an accident, the vehicle’s driver, 58-year-old Dephine Swierc of Norwalk, said she “may have been.” The officer said he immediately detected an alcoholic odor, and the vehicle’s damage was consistent with the accident scene.
Swierc was asked to exit the vehicle and perform a series of field sobriety tests, which she did not pass.
Swierc was then arrested and taken to Darien Police headquarters. She submitted to a breathalyzer test that showed a BAC of .2274, and when tested again 20 minutes later, the result showed a reading of .2194.
Swierc faces the following charges:
- Operating under the influence of alcohol/drugs
- Failure to drive at a safe distance
- Evading responsibility of a motor vehicle accident
Swierc was released after posting a $250 bond. She is scheduled to appear in Stamford court on Monday, Jan. 7.
